Welcome to DroidPlanet Family Tree. These Terms of Service ("Terms") govern your use of our family tree application and services. By creating an account or using our service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using DroidPlanet Family Tree, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our service.
2. Account Registration
Eligibility
- You must be at least 13 years old to create an account
- You must provide accurate and complete registration information
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
Account Security
- This website uses passkeys - which are stored on your computer/device, not in our database.
- A PIN is required for account recovery. Keep a record of this is a safe place!
- Notify us immediately of any unauthorized access to your account
- Do not share your account credentials with others
3. User Responsibilities
You agree to:
- Provide accurate information when creating or editing family tree records
- Respect the privacy and rights of individuals included in family trees
- Not upload or share offensive, defamatory, or inappropriate content
- Comply with all applicable laws regarding data collection and privacy
- Use the service only for lawful, genealogical purposes
- Respect intellectual property rights, including those related to GEDCOM files
4. Content Ownership and Rights
Your Content
- Ownership: You retain ownership of all family tree data you create or upload
- License to Us: You grant us a limited license to store, display, and process your data to provide the service
- Responsibility: You are solely responsible for the accuracy and legality of your content
- Backup: You are responsible for maintaining backups/exports of your data
Shared Trees
- Tree Owners: Have full control over their trees and can manage access permissions
- Contributors: Can add and edit content subject to owner approval
- Viewers: Have read-only access to trees shared with them
- Collaboration: By sharing a tree, you grant collaborators the right to view the data according to their permission level
5. Prohibited Uses
You may not use DroidPlanet Family Tree to:
- Violate any laws or regulations
- Infringe on the privacy rights of others
- Upload false, misleading, or defamatory information
- Harass, threaten, or harm other users
- Attempt to gain unauthorized access to our systems or other user accounts
- Use automated scripts or bots to access the service
- Reverse engineer, decompile, or attempt to extract source code
- Resell or commercially exploit the service without permission
- Upload malicious code, viruses, or other harmful content
- Use the service for any purpose other than creating and managing family trees
6. Service Availability
- Uptime: We strive to maintain high availability but do not guarantee uninterrupted service
- Maintenance: We may perform scheduled or emergency maintenance that temporarily interrupts service
- Modifications: We reserve the right to modify, suspend, or discontinue any part of the service
- No Warranty: The service is provided "as is" without warranties of any kind
7. Data Export and Portability
You have the right to export your family tree data at any time using our GEDCOM export feature. This ensures you always have access to your genealogical research in a standard format that can be imported into other genealogy applications.
8. Collaborative Workflow
For shared/collaborative trees, although we have implemented permission workflows to maintain data integrity, we are not responsible for owner or contributor actions that modify or delete your data.
9. Subscriptions
- Paid Subscriptions: We offer paid subscription plans to access our services.
- Service Tiers: Features and access levels are determined by your selected plan (Free, Basic, or Premium).
- Auto-Renewal: Basic and Premium plans are subscription services that renew automatically at the end of each billing period.
- Cancellation: You can cancel your paid subscription at any time to stop future charges. Upon cancellation, your account will revert to the Free plan, which may limit your access to certain features.
- Payment Processing: All subscription payments are processed securely through Stripe.
- Refunds: Subscription fees are generally non-refundable, except as required by law.
10. Intellectual Property
- Our IP: DroidPlanet Family Tree, our logo, and all software are owned by DroidPlanet and protected by copyright
- User Content: You retain all rights to your family tree data
- GEDCOM Standard: GEDCOM is an open standard for genealogical data exchange
- Trademarks: All trademarks are the property of their respective owners
11. Privacy and Data Protection
Your use of our service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy for detailed information.
12. Account Termination
Termination by You
- You may delete your account at any time through the settings page
- Upon deletion, your account and associated data will be permanently removed
- We highly recommend you export your data before deleting your account
Termination by Us
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in fraudulent, abusive, or illegal activity
- Compromise the security or integrity of our service
- Fail to respond to our requests for information within a reasonable time
13. Disclaimers and Limitation of Liability
Service Disclaimer
DroidPlanet Family Tree is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure.
Data Accuracy
We do not verify the accuracy of user-submitted family tree data. You are responsible for verifying and maintaining the accuracy of your genealogical information.
Limitation of Liability
To the maximum extent permitted by law, DroidPlanet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or cost of substitute services arising from your use of DroidPlanet Family Tree.
14. Indemnification
You agree to indemnify and hold harmless DroidPlanet, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of another person or entity.
15. Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

If you have a dispute with us, please contact us first at familytree@droidplanet.net to attempt an informal resolution.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or a notice in the application. Your continued use of the service after changes are posted constitutes acceptance of the modified Terms.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DroidPlanet regarding your use of DroidPlanet Family Tree.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
